Child rights panel seeks report on surrogate twins of gay Spanish couple

The Delhi Commission for Protection of Child Rights has written to IVF Fertility Research Centre owner Dr. Anoop Gupta here asking for details about assisting a gay couple from Spain to have twins through a surrogate mother in Delhi.

“Keeping in view the rights of the twins and their best interest as defined in the Indian laws, the Commission would like to know about the process adopted in surrogacy in this case. In the present case, the Commission has also expressed its concern over the process followed for the said adoption, if any, as per the provisions under Juvenile Justice (Care and Protection) Act, 2000,'' noted the Commission chairperson Amod Kanth.

Inter-country adoptions

“In the case of inter-country adoptions as contained in the Central Adoption Resource Authority guidelines, it is mandatory to abide by certain procedures and conditions. The Commission views the entire episode seriously as the children are being taken out of the country amounting to an inter-country adoption,” added Mr. Kanth.

The Commission has asked Dr. Gupta to appear before it to explain the case along with supporting documents on February 21.
